By making a studio booking, it is deemed that you understand and agree to the following 'Terms and Conditions.'
Bookings:
To make a booking for 'Photography by Jules', either studio or location, a deposit of £25 is required to secure a booking, unless by prior agreement.
A deposit can be made by bank transfer or PayPal, via the website. (or, ask for details)
Deposits:
A deposit is only refundable, providing 5 days notice or more is given prior to the booking, however the studio reserves the right to charge an optional administration fee of 50% of the deposit.
Proof images:
Screen resolution proof images are provided for viewing after a shoot.
All preview images may be used and shared with family and friends, across your social media accounts.
However, images must be used as supplied, together with any watermarks, logos or website references.
Final Images:
Hi res images are released upon final payment of any outstanding balance, unless prior credit terms have been agreed.
Final images/prints etc. Images can be supplied without my watermark on the actual image by request, but are still supplied with my website address and small signature 'Jules' in the bottom right of the image, to prove authenticity.
TERMS AND CONDITIONS
Agreement
It is agreed that the terms set out in this booking form is the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing
Coverage
The client understands and accepts that the photographic coverage will be as the photographer’s professional expertise determines and that no one photograph will be deemed more important than another. Requests are not binding instruction, although every effort is made to comply with the client’s wishes.
Special Requests
Any special requests must be made prior to booking the studio, they must be made by the client to the photographer/s in writing in a photographic brief.
Photography
On exceptional occasions and with very short notice it may be necessary for the photographer to cancel and reschedule a booking (e.g. due to poor weather or ill health). You will be contacted as early as possible prior to the shoot.
Images
All image sizes are nominal. The photographer/s will provide as correct a colour balance as taken under the lighting conditions, but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to record either digitally, or on film the exact colour as seen by the human eye.
Additional Retouching
Additional retouching, digital manipulation and image finishing is available to the client as an optional extra, unless discussed prior to a booking. So that any special retouching requests can be discussed beforehand.
Copyright & Credits
Copyright - All images taken by me remain copyright of me 'Jules'.
Any images or copies of images, whether stored digitally or otherwise, and on any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/ electronically or by any other means an image created as part of this contract without the permission of the photographer/s in writing.
Credits - 'Photography by Jules' must be credited in any images used in the form of - " ©Photography by Jules - www.photographybyjules.uk "
Images/Digital Files
Images/digital files remain the property of the photographer, 'Jules'
Licence
The photographer, shall be granted complete artistic licence in relation to viewpoint, composition, lighting, together with the poses photographed and the locations used. The photographer's judgement regarding the above, shall be final.
Location 'people & model shoots', due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested.
Force Majeure or Act of God
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.
Previews
Although I will do my best to produce more images than discussed with the client, there is no guarantee that any particular number of proofs/preview prints will be produced.
Display
The client hereby allows the me, the photographer to use any images included in this contract for photographer's own use in, portfolios, literature, exhibitions and advertising. No use of the images will be made by the photographer/s for other commercial reason except with the written permission of the client.
Cancellations
The client may cancel this contract at any time by giving written notice to the booking but in doing so shall forfeit any deposit or monies paid. Should cancellation be received by the photographer less than 48h hours prior to the booking, the client my in addition, pay a sum equal to 10% of the total contract value.
The said sum shall be payable as compensation as an estimate of the loss the photographer would suffer.
Limitation of Liability
In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
Complaints
Any complaints should be raised by the client with me in writing, within 14 days of first becoming aware of the matter to be complained of and in any event within 14 days of receipt of the images.
I have read this booking form and agree to abide by the terms of agreement set out in it. I understand that the terms of this agreement cannot be changed unless agreed by both parties in writing.
